Taxi travel is exempt from FBT – not ride-sharing
Did you know, ‘taxi travel’ between home and work is exempt from Fringe Benefits Tax (FBT) under s. 58Z of the Fringe Benefits Tax Assessment Act 1986 (“the Act”). The Act provides a statutory definition of ‘taxi travel’ being ‘…in a motor vehicle that is licensed to operate as a taxi.” (Refer to s. 136(1))At the FBT States and Territories Industry Partnership meeting held on 6 November 2015, the ATO noted that the s. 58Z exemption “…does not extend to ride-sharing services provided in a vehicle that is not licensed to operate as a taxi.” The reason why is “…because transport provided via uber does not strictly represent the provision of a motor vehicle that is “licensed to operate as a taxi”.
